{"id":20072,"date":"2022-03-16T12:49:59","date_gmt":"2022-03-16T11:49:59","guid":{"rendered":"https:\/\/test.centralpay.eu\/all-you-need-to-know-about-electronic-money\/"},"modified":"2025-10-16T14:28:45","modified_gmt":"2025-10-16T12:28:45","slug":"everything-you-need-to-know-about-e-money","status":"publish","type":"post","link":"https:\/\/www.centralpay.com\/en\/blog\/everything-you-need-to-know-about-e-money\/","title":{"rendered":"Electronic money: everything you yeed to know"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-text-align-left\"><strong>What is the legal framework for electronic money?<\/strong><\/h2>\n\n<div style=\"height:1px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-text-align-left\">Genesis<\/h3>\n\n<p>Historically, money is divided into two categories:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Fiduciary money: Physical instruments (coins and banknotes)<\/strong><\/li>\n\n\n\n<li><strong>Scriptural money: Account entries (banker&#8217;s checks, bills of exchange, promissory notes, and other &#8220;payment instruments,&#8221; such as credit transfers and direct debits)<\/strong><\/li>\n<\/ul>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In 2000, the &#8220;Electronic Money Directive 1&#8221; (Directive 2000\/46 of September 18, 2000) first defined electronic money as &#8220;<em>an electronic substitute for coins and banknotes, which is stored on an electronic medium such as a smart card or computer memory and which is generally intended for making electronic payments of limited amounts.<\/em>&#8220;<\/p>\n\n<p>In this first version, it constitutes a new cashless payment instrument, intended to carry out a payment transaction associated with an account.<\/p>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-text-align-left\">The Electronic Money Directive 2 (EMD2)<\/h3>\n\n<p>In the 2000s, the digital economy exploded, accelerating the introduction of new payment instruments designed to simplify transactions and payment processes.<\/p>\n\n<p>In 2009, the Electronic Money Directive 2 (Directive 2009\/110\/EC of September 16, 2009) filled certain gaps observed in the original version, in order to pursue the European Union&#8217;s desire to create &#8220;<em>a clear legal framework to strengthen the internal market&#8221; and &#8220;ensure an adequate level of prudential supervision.<\/em>&#8221; This notably involves the creation of the autonomous status of <strong>Electronic Money Institution<\/strong> (EMI) and the prudential supervision obligation for these new entities. <\/p>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-outline is-style-outline--1\"><a class=\"wp-block-button__link has-text-color has-link-color wp-element-button\" href=\"https:\/\/www.centralpay.com\/en\/blog\/what-are-the-requirements-for-an-e-money-institution\/\" style=\"border-radius:5px;color:#212121\">Also read: Why use an Electronic Money Institution? \u279c<\/a><\/div>\n<\/div>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-text-align-left\">Definition<\/h3>\n\n<p>It was in 2013 that the DME was transposed into French law by the law of January 28, establishing the definition of electronic money as we know it today.<\/p>\n\n<p>Within the meaning of <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027007558\" target=\"_blank\" rel=\"noopener\">Article L. 315-1 of the French Monetary and Financial Code<\/a>, it constitutes &#8220;<em>a monetary value stored in electronic form, including magnetic form, representing a claim on the issuer, which is issued against the remittance of funds for the purpose of payment transactions [&#8230;] and which is accepted by a natural person other than the electronic money issuer.<\/em>&#8220;<\/p>\n\n<p>This definition clarifies the scope of application of electronic money, introduces certain related concepts (prepayment, electronic money media, etc.), and defines it, above all, as a true &#8220;payment service&#8221; in its own right.<\/p>\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading has-text-align-left\"><strong>How electronic money works<\/strong><\/h2>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>In practice, this form of money follows a cycle (issuance\/storage\/use) involving three parties:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>The holder (end customer): The person who purchased or received the electronic money medium.<\/strong><\/li>\n\n\n\n<li><strong>The acceptor (merchant): The person who accepts payment using the electronic money medium.<\/strong><\/li>\n\n\n\n<li><strong>The issuer: The Electronic Money Institution (EMI) that issues the electronic money.<\/strong><\/li>\n<\/ul>\n\n<div style=\"height:1px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-text-align-left\">1 | Issuance<\/h3>\n\n<p>In accordance with the Monetary and Financial Code, electronic money is based on the <a href=\"https:\/\/www.centralpay.com\/en\/blog\/e-money-what-is-prepaid-value\/\">concept of prepayment<\/a>. Therefore, we do not speak of &#8220;creation,&#8221; but rather of the issuance of electronic value. <\/p>\n\n<p>Upon purchase or creation of the medium in ISO currency, the equivalent in EM is immediately issued and secured by the Electronic Money Institution in charge.<\/p>\n\n<div style=\"height:15px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading has-text-align-left\">2 | Storage<\/h3>\n\n<p>Once issued, this value is stored on a medium, backed by an electronic money account, which is different from a traditional bank account.
